Privacy Policy and Personal Data Protection - GDPR - Solomun d.o.o.

GENERAL PRINCIPLES 

Solomun d.o.o. undertakes all necessary technical and organizational measures in accordance with the best practice and obligations prescribed by Croatian law, within which the activities of the company, and in particular the protection and processing of personal data prescribed by the Personal Dana Protection Act and the General Data Protection Regulative (EC 2016/679) - GDPR. 

The information system used by Solomun d.o.o. is protected by state-of-the-art encryption and security standards. 

The specific purpose and the way of processing your personal information is greatly dependent onthe type of business relationship that this data is collected for. In its business Solomun d.o.o. is guided by the fundamental principles of the protection of personal data, which means that the data is processed legally, transparently and fairly, and that processing is limited only to the purpose for which the data was collected and that only the data necessary for that purpose is processed. 

Your personal data is kept only as long it is necessary for processing purposes, except where there is arequirement for longer keeping of personal data due to certain statutory regulations, ie when it is determined by the legal obligations of the company. 

Access to some of your personal data can be granted only to those data processors who are, where appropriate, present in the business of real estate mediation and in the work of ordering, making and delivering products and services such as lawyers, public notaries, court experts and interpreters, other state public and city authorities, architects, licensed energy certifiers, insurance companies, contractors, banks and other financial institutions, financial advisors, service providers, building managers, business partners and suppliers, and courier services.

Purpose of processing and legal basis for processing personal data

Solomun d.o.o., as the manager of personal data processing, protects your privacy and processes only personal information that is necessary and which are obtained within the business activities of the company, whether that data has been obtained from you personally, by third parties or publicly available sources, for the following purposes:

1. execution of contractual obligations - when processing is necessary for the performance of the contract to which you are a party or to take action on your request prior to the conclusion of the contract

2. fulfilling legitimate interests - where necessary, personal data is processed beyond the specific contractual relationship, and in order to fulfill legitimate interests of Solomun d.o.o. For example, such legitimate interest may be:

• conducting court proceedings and keeping records of them
• detection of perpetrators of criminal offenses and the prevention of fraud
• protection of persons and property
• meeting your requirements or for the internal needs of Solomun d.o.o., such as auditing and data analysis
• answering your inquiries and comments

3. respecting the legal obligations - given the different business activities, Solomun d.o.o. is obliged to abide by numerous legal obligations such as compliance with the Law on the Prevention of Money Laundering and Financing of Terrorism, the Law on Mediation in Real Estate Transactions and others.

4. processing of personal data for a special purpose or for a number of special purposes solely upon receiving your written consent on personal data processing for such purposes. Your consent is in compliance with the relevant regulations of the introductory GDPR regulative, it is given with free will without any oustide influences. You also retain the right to revoke it at any time.

Which personal information is collected and how do we get them? 

Company Solomun d.o.o. processes personal data that is collected during a business relationship, suchas name, surname, Personal ID no., address, real estate data etc. However, if this is necessary for the performance of company business activities and is not related to a specific contractual or business relationship, it is collected from public sources (Court Registry, Land Registry, FINA) or legally communicated to the company by contractual partners or third parties.

Are you required to provide us with personal information?

You do not have to submit your personal data with the note that, in that case, the company Solomun d.o.o. will not be able to fulfill its legal obligations and engage with you in a legitimate business and contractual relationship.

The period for which the data will be stored

Company Solomun d.o.o. will keep your personal information only to the extent necessary to comply with the contractual or legal obligation or the legitimate interest of the company, except in the case of personal data processing on the grounds of your written consent, when the processing stops at the time when that consent has been withdrawn. Your consent can be withdrawn at any time by sending the request to this e-mail address: nekretninesolomun@gmail.com  with the note that the withdrawal of the consent does not affect the lawfulness of the processing based on it before it was withdrawn. If your personal data will no longer be required to fulfill the above purpose, it will be destroyed, unless furtherkeeping is prescribed by law.

Who is the recipient of your personal information?

Solomun d.o.o. is bound to keep your personal information and will not make it available to third parties without your special consent, except to:

• Service Providers that we engage with related to the contract where you are a party
• competent public bodies for the purpose of carrying out the tasks within their competence
•  when these data are required by the court or the state attorney's office or other bodies in equal legal proceedings
• when there is a statutory duty to deliver this information

What are your rights when it comes to processing of your personal information?

Depending on the legal basis of the processing your rights may be as follows: 
• request access to your personal data, ie you have the right to information on the scope of the data collected, the purpose of processing, the category of personal data processed, the recipients to whom the data is delivered and the storage period 
• request correction of inaccurate or incomplete personal data 
• complain about personal data processing 
• request the removal of data when the purpose of the processing is met or when you withdraw the consent as the sole basis for processing, when this is necessary to fulfill the legal obligations of Solomun d.o.o. and in the event of any unlawful processing. The right for removal is not an absolute right and does not apply, for example, in cases where processing is necessary for excercising the right to freedom of information and expression, in order to comply with legal obligations under Solomun d.o.o.,for the purpose of establishing, enforcing or defending legal requirements and similar 
• limit the processing of data in case there is a dispute on data accuracy until the accuracy of the datais verified 
• transfer the data to the another processing manager if the processing is based on the written consent or execution of the contract in which you are a party, ie if the processing is automated and if it is technically feasible 
• file a complaint with the national supervisory body
